Rule 17
Abandonment of Area
: (1) The Contractor shall abandon the Area as follows :
(a) By the end of the primary exploration period, at least fifty (50) percent of the initial contract area excluding the area falling under the production area.
(b) At least twenty-five (25) percent of the initial contract area excluding the production area by the end of the first exploration period.
(c) Subject to sub-rule (2) of rule 16, all the remaining areas of the initial contract area except the area falling under the production area till the end of the exploration period. Explanation: For the purpose of sub-rule (1), production area also means the area mentioned in such application in case the application for production permit is pending.
(2) Notwithstanding anything contained in sub-rule (1), each area to be abandoned from time to time shall not be less than (10) percent of the initial contract area and shall be in one circle.
(3) If the contractor does not apply for a production permit even after the completion of feasibility work at a site, the Government of Nepal shall have the right to order the contractor to abandon additional areas including such site as approved in the Petroleum Agreement. In case of such an order, the contractor shall abandon such area as written in the petroleum contract.
(4) The contractor may at any time during the exploration period abandon any part of the contract area and all such voluntary abandonment shall be included in the compulsory abandonment specified in sub-rule (1).
